Terms and Conditions

Effective from: [05/02/2026]

These Terms & Conditions ("Terms", "Agreement") govern the provision and use of hosting, domain, IT, and related digital services provided by VMotion Host, an Irish-registered company ("VMotion", "we", "us", "our"). By using our services, you ("Client", "you", "your") agree to be bound by these Terms.

1. Agreement:

This Agreement forms a legally binding contract between you and VMotion. By creating an account, purchasing a service, or using our services, you agree to these Terms.



2. Compliance with Law:

You agree to use VMotion services in accordance with all applicable Irish and EU laws. VMotion operates its services in compliance with all relevant local, national, and international regulations.



3. Account Activation, Billing & Suspension:

VMotion may suspend or deactivate your service for:

  • non-payment,
  • suspected fraud,
  • misuse of services,
  • security risks.

Cancellation after activation may still result in charges for services already performed (e.g., domain registrations).



4. Domain Registration & Renewal (Non-Refundable):

Domain registration/renewal begins immediately once payment is processed. These services cannot be reversed, so fees are non-refundable.

Domain registrations and renewals are processed immediately and cannot be cancelled or reversed once submitted to the registry. By placing a domain order, you expressly request immediate performance of the service and acknowledge that you lose your 14-day right of withdrawal under the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013. All domain fees are therefore non-refundable.



5. Warranties & Liability:

VMotion does not guarantee uninterrupted or error-free service. Nothing in these Terms removes consumer rights under the Consumer Rights Act 2022. VMotion's total liability is limited to the fees paid by the Client for the affected service in the previous 12 months, except where prohibited by law. VMotion does not exclude liability for death, personal injury, or fraud.



6. Consumer Rights & Guarantees:

If a digital service fails to conform to its description, VMotion will repair, replace, or refund as required by:

  • Irish consumer law,
  • EU Digital Content & Digital Services Directive.


7. Use of Information & Third-Party Content:

Information accessed through VMotion services is used at your own risk. We are not responsible for the completeness, accuracy, or reliability of third-party content.



8. Cancellations & Refunds:

You may terminate a service with three (3) working days notice by email or post.

  • Hosting fees are refundable within 30 days (excluding setup fees, licence fees, managed support fees, domain fees).
  • After 30 days, refunds are pro rata.
  • Refunds are processed within 14 working days.
  • Statutory cancellation rights remain unaffected for services not yet provided.


9. Service Provision & Setup Times:

  • Shared hosting is activated automatically (usually within minutes).
  • VPS and Dedicated Servers may require ID or business verification. If documents are not provided within 72 hours, the order may be cancelled and refunded. VPS setup: within 36 hours. Dedicated Servers: within 72 hours.


10. Acceptable Use & Restrictions:

Clients must not use services for:

  • Illegal activity
  • Spam or mass unsolicited email
  • Hosting malware or harmful content
  • Abusive behaviour towards staff

VMotion may investigate abuse complaints and may access limited technical data or logs only when required for:

  • Security,
  • Service integrity
  • Abuse investigation
  • Compliance with law

VMotion does not access customer content for any other reason.



11. IP Addresses:

VMotion retains ownership of all assigned IP addresses. IPs may be reassigned as needed. Abuse causing blacklisting may incur a €250 per-IP removal fee.



12. Data Protection (GDPR):

VMotion processes personal data in compliance with:

  • EU GDPR (2016/679)
  • Irish Data Protection Act 2018

13. Confidentiality:

Both parties will keep confidential all non-public information exchanged for the purpose of service delivery. This obligation survives the termination of services.



14. Data Portability & Account Termination:

Before account deletion, Clients may export their data. VMotion deletes client data within 30 days of termination ie. any data will be lost, except where legal retention is required (e.g., tax records).



15. Service Availability & Backups:

VMotion aims for high uptime but offers no guarantee against outages. VMotion keeps backups of key server systems only and these backups are not available for client use unless a paid backup service is active. Restoration services may incur fees if not included in your plan.



16. Changes to Terms:

VMotion may update these Terms with 30 days' notice via email or website. Continued use after the effective date means acceptance. You may cancel before the change takes effect.



17. Governing Law & Jurisdiction:

This Agreement is governed by Irish law, and any disputes arising under it shall be subject to the exclusive jurisdiction of the Irish courts.

Consumers may use the EU Online Dispute Resolution platform here



19. Support Terms:

19.1 Support Channels

  • 24/7/365 ticket support
  • Phone & live chat: 09:00-18:00 (Irish Time - Mon-Fri, excluding public holidays)
  • Infrastructure and hardware are monitored continuously

19.2 Scope of Standard Support

  • login/access issues,
  • hosting environment diagnostics,
  • DNS, SSL & domain set-up help
  • basic application setup for VMotion-provided software,
  • Unblocking/whitelisting client IPs on VMotion hardware.

19.3 Out-of-Scope Support (May incur charges)

  • Website development or code debugging
  • SSL configuration
  • Email Client Configuration
  • Third-party applications
  • Malware clean up unless covered by plan
  • Data recovery from non-paid backups
  • Consultancy or training
  • A deposit may be required before any paid support work begins. The deposit is applied against the time or work completed. If the final cost is less than the deposit, the remaining balance will be refunded or added as account credit. Work will not begin until the deposit is received. Once work has started, charges apply for the work completed.

19.4 Fair Use of Support

  • Users must behave respectfully towards staff.
  • Excessive support usage (e.g., opening more than 5 tickets per month on non-managed plans) may result in fair-use limitations.
  • Support Packages offer a limited amount of hands on support based on the package and or package tier.
  • If a customer exceeds the limit of hands on support, charges per hour will incur.

19.5 Support Packages

  • Current Care Packages are limited to 3 hours of hands on support per month.


20. Right to Refuse or Terminate Service:

VMotion reserves the right to refuse service to any individual or organisation for any reason not prohibited by law and to terminate existing services where permitted by law.



21. Intellectual Property & Infringement:

You agree that any material submitted, hosted, or transmitted through VMotion services will not infringe any copyright, trademark, patent, statutory, or proprietary rights of any third party, nor contain unlawful or defamatory material. VMotion may suspend or terminate services without notice where such material is identified. You agree to indemnify and hold harmless VMotion from any claims arising from such material.



22. Indemnification:

You agree to indemnify and hold harmless VMotion from any claims, damages, liabilities, losses, costs, expenses, or legal fees arising from your use of the services, violation of these Terms, or violation of applicable law.



23. Spam & Email Abuse:

Use of VMotion services for unsolicited bulk email, mass mailing, or spam is strictly prohibited. A first spam offence may result in immediate termination of services without refund.



24. Right to Inspect Data:

VMotion has the right, but not the obligation, to inspect information stored on its servers solely for the purpose of enforcing this Agreement or complying with applicable law.



25. Legal Disclosure:

VMotion will comply with any lawful court order or legal requirement to disclose Client information where required.



26. Renewal, Suspension & Late Fees:

Unless otherwise stated, services do not automatically renew. VMotion will issue renewal notices prior to expiry. Services may be suspended for non-payment, a late fee of 10% may apply, and services unpaid for 30 calendar days after due date may be terminated with all data permanently deleted.



27. Shared Hosting Resource Limits:

Shared hosting services are subject to limits on CPU, RAM, disk I/O, storage, and concurrent connections. These Terms should be read together with the Acceptable Usage Policy.



28. Acceptance of Terms:

Use of VMotion services constitutes acceptance of these Terms and Conditions in full.



29. Severability:

If any part of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.



30. Entire Agreement:

These Terms constitute the entire agreement between you and VMotion and supersede all prior agreements or understandings relating to the services.
